Doesn't matter to me if they have a union or not ... but, I would not call 30 out of 83 a "clear desire of the employees" - it looks like 53 of them are content with the way things are
Has me wondering if there are rules on low-turnout union elections. Like, some referenda require either (1) a given share of the eligible voter pool to show up or (2) a given share of the eligible voter pool to vote one way or the other for the result to be binding. This was what infamously tanked the Scottish devolution referendum in the 70s - the referendum got just under 52% of voters in favor, but there was a requirement that the referendum also be supported by 40% of the electorate and that wasn't met.

NLRB is based on the people voting, just like most all the elections in this country (I live in a state that does not allow referendums). If one person votes then that is the election. Tied vote totals means the union loses, not the company. It used to be in NMB elections (railroad and airline companies) that for the union to win the union had to get 50% plus 1 of eligible voters. Folks staying away was counted as a no vote for the union. A few years ago the rules for NMB elections were changed to reflect how most every out election is held in this country and around the world.

This union election was held with the rules that are established being known by all involved. There were more votes for TWU than no union and the result would be the same regardless whether it was NLRB or NMB. Time for Brightline to accept that result. And if they are not a railroad then they need to return all the tax dollars they gladly took for passenger railroads.
