Here's the video from the passenger car view since Virtual Railfan has taken down videos for copyright.
It is possible that someone at Youtube went a bit overboard and erred on the side of safety for Youtube by removing all videos of the incident without regard to source and actual Copyright ownership.I don't know how they can claim copyright on a random strangers video.
Right. It is entirely the fault of the crew for being unable to stop within sight distance of the obstruction. Only mitigating factor possible would be a total brake failure or something like that I suppose.Jumping back on here…
It amazes me that in all of the comments on social media and boards about this that so few people know the meaning and purpose of “restricted speed” and insist that the blame falls on whoever parked the equipment there, not the crew.
Some museums do not allow photography as a matter of policy (many art museums for example), or require that people wishing to take photographs submit to certain legal requirements (which can include private use being acceptable but publication and sharing not). Such clauses can often be hidden in the small print and most visitors may not be aware. But it may indeed be possible that in such cases photographers do not have copyright to their own work.I don't know how they can claim copyright on a random strangers video.
